Statement of Student's Rights in the Disciplinary Process
When a student appears for a judicial hearing before a representation of the Office of Student Conduct, the following procedural rights will be afforded:
- The opportunity to read all written reports regarding the circumstances and allegations of the case.
- The opportunity to attend a hearing that shall not be earlier than three calendar days after the date of the notice.
- The opportunity to give a reaction to the reports and offer any additional information which might help in the resolution of the case.
- The student is not required to answer any questions, which may be asked during the hearing; the choice to remain silent will not be taken as an admission of responsibility.
- The opportunity to be presented any information related to the case, which may adversely affect the student, and to submit questions related to this information.
- The opportunity to present witnesses which substantiate circumstances related to the incident. A list of witnesses must be submitted no later than three (3) calendar days before the hearing.
- The opportunity to have a support person present during the hearing; that support person may not participate in presenting the case, question witnesses, or make statements during the hearing.
- The opportunity to receive written notification of the decision of the disciplinary meeting within ten (10) calendar days, barring unforeseen circumstances.
- The opportunity to submit an appeal subject to the condition of the appeal process, by the appeal deadline date stated in the written notice. Conditions for an appeal are enumerated in the Student Handbook.
